US Dept. of Education Department Issues New Regulations under NCLB for ELL students
The U.S. Department of Education (ED) has issued final regulations implementing the accountability provisions for limited English proficiency (LEP) students under the No Child Left Behind Act (NCLB). Under the final regulations, a "recently arrived LEP student" may be exempt from one administration of the state's reading/language arts assessment.
The U.S. Department of Education (ED) has issued final regulations implementing the accountability provisions for limited English proficiency (LEP) students under the No Child Left Behind Act (NCLB). Under the final regulations, a "recently arrived LEP student" may be exempt from one administration of the state's reading/language arts assessment. A "recently arrived LEP" student now is defined as one who has attended school in the U.S. (excluding Puerto Rico) for less than 12 months. The final regulation specifies that schools are obligated to assist recently arrived LEP students in gaining English proficiency regardless of whether they will be exempt from the test that year.
